Acceptance of Terms

By using the Phantom Troupe web site ("Service"), all services of Phantom Troupe, you agree to be bound by the following terms and conditions ("Terms of Service"), including any subsequent changes or modifications to them. You are responsible for reviewing the TOS periodically for any modifications. These terms and conditions apply to web sites and interactive services (hereafter individually a “Service” and collectively the “Services”) owned or operated by Phantom Troupe (hereafter the “Company”, “Phantom Troupe”, “we”, “us”, “our”) and its subsidiaries and affiliates. By registering for an account and/or becoming a member to purchase a license for services offered on Phantom Troupe (hereafter the “Site”) you confirm your knowledge of and agreement to be bound by the then most current version of the TOS, which can be accessed from the Site. If you do not agree with these terms, please do not register or use this Service. If you wish to close your account, please contact us.

Phantom Troupe RESERVES THE RIGHT TO IMMEDIATELY SUSPEND AND/OR CLOSE THE ACCOUNT OF ANY MEMBER WHO VIOLATES, OR WHOM PHANTOM TROUPE REASONABLY BELIEVES MAY BE OR WILL BE VIOLATING, THESE TERMS AND CONDITIONS OF SERVICE, AT ANY TIME WITHOUT NOTICE.

User Content

All Content you submit or upload may be reviewed by staff members. All Content you submit or upload may be sent to third-party verification services (including, but not limited to, spam prevention services). Do not submit any Content that you consider to be private or confidential.

We reserve the right to remove or modify any Content submitted for any reason without explanation. Requests for Content to be removed or modified will be undertaken only at our discretion. We reserve the right to take action against any account with the Service at any time.

You are granting us a non-exclusive, permanent, irrevocable, unlimited license to use, publish, or re-publish your Content in connection with the Service. You retain copyright over the Content.

User Account

Your Account, including any information pertaining to it (e.g., contact information, Account status, Account history, and Subscriptions, etc.), is strictly personal. You may not sell or charge others for the right to use your Account, transfer your Account, nor may you re-sell, exchange your account, or transfer ownership to another individual. You are responsible for the confidentiality of your login and password and for the security of your computer system that your account is hardware linked to. We are not responsible for the use of your password and Account or for all of the communication and activity on Phantom Troupe that results from use of your login name and password by you, or by any person to whom you may have intentionally or by negligence disclosed your login and/or password in violation of this confidentiality provision. Phantom Troupe is not responsible for the use of your Account by a person who fraudulently used your login and password without your permission.

Your user account on Phantom Troupe which grants you access to Phantom Troupe services should only be accessed by you and you only. We don't allow sharing of accounts between individuals; if our system detects any user sharing accounts, the account being shared will be locked/banned and access will be denied indefinitely to the software loader. Once you have purchased a subscription you will be granted the ability to register a device to link with your account (authorize), this device and this device ONLY will be allowed to use the service. Your account can be de-authorized, but 4h will be taken off your subscription.

Subscriptions

When you purchase a subscription service from our website, the subscription will start when we confirm your payment and stop at the end of the purchased period. We do not freeze subscriptions. If you have purchased an ongoing subscription which renews at the end of every month, you may cancel this through our store page so you are not billed the next month. Subscriptions may grant a limited non-exclusive license to use software that is only accessible to users of a specific user group, however, this access may be subject to termination, maintenance downtime, or discontinuation. In which case compensation will be offered. The downtime hours will be added back to your subscription.

Payments and Refunds

Since our services provide electronic, virtual intangible goods we do not offer refunds. You will not receive any refund for partial or non-usage of the services provided. Please make sure the subscription you are going to purchase is right for you. After logging into our software distributor and accessing our private, paid user-group forums, you will have received the full value of your subscription and will no longer be eligible for any refunds.

Unauthorized use of funds for payment, fraudulent payments, attempts to ‘charge back’ or deny payments to your account will result in your account being instantly disabled, permanently terminated and/or legal action will be taken.

Assumption of Risk - Anti-Cheat Software

Some products or services offered by Phantom Troupe may be intended for use on video game software protected by anti-cheat technologies. Some products or services may additionally offer support for such anti-cheat technologies. Support for anti-cheat technologies does not necessarily guarantee that any Phantom Troupe product or service will be undetected on that particular anti-cheat. Phantom Troupe is not responsible for any damages incurred from using any Phantom Troupe product or service on a product that is protected by any anti-cheat technology. Disputes or payment reversals are not permitted in the event that a Phantom Troupe product or service is detected by anti-cheat technology.

Registration Terms

These terms of service govern all use of this website and products and services offered on this website. Whenever we use Phantom Troupe, we refer to the owners of this website.

Website usage

By using this website, or by purchasing a Phantom Troupe product, you accept these terms of service in full. If you disagree with these terms of service, you must not purchase or use the services and products offered by Phantom Troupe as well as this website.

Phantom Troupe reserves the right to deny access to the website and forum at any time, at our sole discretion.

If you are from the following list or a known association or agent, you may not access this website any further or purchase products without express permission from the owners of Phantom Troupe;

• Any anti-cheat organization or any other gaming-related company such as:
  • evenbalance, valve, activision publishing, inc., electronic arts, smilegate, hi-rez studios, ijji, nexon, nprotect, wellbia, gamersfirst, nether llc, gameforge ag, battleye innovations e.k, easy anti-cheat, epic games, black cipher security, or an agent of any other gaming network.

Restricted countries

You may not buy or use our products or services if you are a resident of or located in the following countries: the Republic of Korea, the People's Republic of China, and Hong Kong Special Administrative Region of the People's Republic of China.

Product usage

A license key or user account, containing the ability to access Phantom Troupe products must have been obtained through purchasing a product through our payment system. Phantom Troupe is not liable for potential claims caused by one of their consumers on intellectual property of third parties. In such events, the consumer protects Phantom Troupe for claims from third parties.

You explicitly agree, in using this website or any service or product provided, that you shall not perform any conduct that may be unlawful, illegal, threatening, harmful, or abusive.

You may only use an account on one computer. However, if that computer is replaced or changed and this causes an inability to use the account, a Phantom Troupe staff member will review your situation and allow access if it is deemed appropriate.

We reserve the right to deactivate or delete an account at any time for the following reasons:

• Sharing an account with another computer or user. If an account is shared between multiple computers, these computers are not regarded as replacement or upgrades by a Phantom Troupe staff member.
• Chargeback, claim or dispute. If you open a dispute or a claim or do a chargeback through any of our payment services, including our merchants of records.
• Misuse of an account. If it is deemed that you have tampered with our software or have tried to use it for purposes of which it was not intended.
• Abuse or misconduct. If you are abusive or do not conduct yourself as we deem appropriate.
• Breaking our community guidelines.
• Working for an opposite entity. If you work for an anti-cheat company or an entity that works against Phantom Troupe in any way.

Refunds of transactions

We have many happy customers and we honor the majority of reasonable refund requests. However, we do reserve the right to deny any refund at any time.

Switching of product

Switching of products is not provided. If you need assistance with your product, please contact customer support.

End-User License Agreement (EULA)

This end-user license agreement (“EULA”) governs all access to and use of the software from Phantom Troupe (“software”). You must read this EULA carefully and accept all the terms and conditions set out below before you are entitled to download, install, and use the software. By downloading the software, you agree to become the licensee to this EULA and consent to be bound by all of its terms. If you do not agree to be bound by all such terms, do not download the software.

This EULA is a legally binding contract between you and Phantom Troupe.

In consideration of the mutual covenants contained herein, you and Phantom Troupe hereby agree as follows:

Phantom Troupe hereby grants you a revocable, limited, nonexclusive license during the term of this EULA to use the software, solely for your personal, non-commercial use, and subject to the limitations set forth in this EULA. Phantom Troupe grants nonexclusive licenses and not exclusive licenses or assignments. All rights not expressly granted in this EULA are reserved.

Limited use

You will not:

• Use the software for any purpose other than a personal, non-commercial one;
• Use the software in any official game servers other than HvH (Hackers Versus Hackers) servers;
• Disclose any of the software;
• Change the software in any way, including “disassemble, decompile or reverse-engineering”;
• Translate, adapt, modify, lease, rent, loan, redistribute, sub-lease, sub-license or create derivative works of/from the software;
• Employ the software for any unlawful purpose.

Your license to use the software is immediately revoked, without notice from Phantom Troupe, in the event that you breach any provision of this EULA.

General Terms

Any party may terminate this EULA upon notice to another. In the event of termination, all licenses hereunder immediately terminate, and you agree to discontinue accessing and attempting to access or use the software and shall forthwith uninstall and delete the software from any device upon such termination.

Disclaimer of warranties

Phantom Troupe provides the software on an “as is,” “as available” basis. Phantom Troupe makes no warranty as to the accuracy, currency, completeness, usability, or reliability of the software. You are advised that the software, though deemed reliable, may contain errors and is subject to revision at all times. Phantom Troupe expressly disclaims all warranties with respect to the software.

Limitations and exclusions of liability

Under no circumstances shall Phantom Troupe be liable to you or anyone else for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages that result from the use of, or inability to use, the software. Your sole remedy, in the event Phantom Troupe or any one of them breaches this EULA, shall be to terminate this EULA.

You irrevocably accept that you are solely responsible for all loss, damage, costs, and expenses suffered and/or incurred arising from, and/or in connection with, the download, installation, and/or use of the software.

Indemnification

You will defend, indemnify and hold Phantom Troupe harmless from and against any and all liability, damages, loss or expense (including reasonable fees of attorneys and other professionals) in any claim, demand, action, or proceeding initiated by any third-party against Phantom Troupe arising from any of your acts, including without limitation violating this or any other agreement or any law.

Assignment

You may not assign or delegate this EULA or any obligations, rights, or duties hereunder. Any attempted or purported assignment or delegation in contravention of this section is null and void.

Integration and severability

This EULA contains the entire understanding of the parties and supersedes all previous oral and written agreements on the subject matter hereof. Each provision of this EULA is severable from the whole, and if one provision is declared invalid, the other provisions shall remain in full force and effect.

Governing Law

This EULA is governed by, and construed in accordance with, the local laws where the headquarters of the owners of this website are located, and you irrevocably submit to the exclusive jurisdiction of the courts where the headquarters of the owners of this website are located.

Applicable Law

You agree that these terms of service and any dispute arising out of your use of this website or our products or services shall be governed by and construed in accordance with local laws where the headquarters of the owners of this website are located, without regard to its conflict of law provisions. By registering or using this website and service, you consent and submit to the exclusive jurisdiction and venue of the county or city where the headquarters of the owners of this website are located.
